Terms and Conditions

The sale of products marketed by CYP Wheels Sarl is governed and regulated by the following conditions of sale. 

1) Acceptance of the Terms and Conditions of Sale

The consumer undertakes to read the terms of sale set out below and to acquire all the necessary information before proceeding to the purchase of products contained in the electronic catalogue of CYP Wheels’ website. The present terms of sale are intended to establish the rights and obligations of the parties in the process of the online sale of CYP Wheels Sarl’s products.
The conditions of sale shall come into force at the time the consumer signs the order form and shall be valid for as long as the goods and services ordered are provided, until the expiration of the warranties provided by CYP Wheels.
By placing an order, the customer declares that he/she has read and fully accepts these terms and conditions of sale and payment. In order to use this website, the consumer must consider that he/she has the necessary skills and tools.
The Consumer accepts that his or her consent to the content of these terms and conditions of sale, does not require a handwritten signature if the customer wishes to order online the products contained on CYP Wheels’ website.
CYP Wheels shall not, under any circumstances, be liable for any damages of any kind that may result from the use of its website, in the event of errors in use, lack of information and/or the presence of viruses.

2) Purchase of Products

a) The customer may only select and purchase products from CYP Wheels’ electronic catalogue.
b) The products for sale are presented on the website with the characteristics necessary to comply with Article 111-1 of the Consumer Code, so that the consumer can know the main characteristics of the products he/she wishes to purchase.
c) The technical information of the products included in the catalogue is the same as that of the manufacturers that produce them CYP Wheels reserves the right to modify it, without prior notice, in order to adapt it to those of the manufacturers when they are updated.
d) The descriptions, characteristics and weights of the items contained in the catalogue of our website are taken from the catalogues and websites of the manufacturers and distributors. CYP Wheels is not responsible for any erroneous information contained in the manufacturers’ catalogues.
e) The purchase order confirmation constitutes an electronic signature that has the same value as the handwritten signature
f) CYP Wheels confirms the acceptance of the order by sending an e-mail to the address provided by the customer with the necessary references (date, time of receipt, order number, etc.). The confirmation contains the data entered by the customer, who is obliged to verify its correctness and to promptly notify any changes.
g) Non-acceptance : CYP Wheels undertakes to promptly inform the customer.
h) Product availability : CYP Wheels’ website displays “availability” at the time of the order. The simultaneous access of customers rapidly changes stocks, therefore CYP Wheels cannot guarantee the certainty of availability of the goods ordered.
i) Promotional products : CYP Wheels reserves the right to accept orders with reduced quantities. The order shall be confirmed if, upon notification, the customer accepts it.

3) Purchasing Prices

a) The published prices include TVA, are expressed in CHF and Euros and do not include the costs of delivery which are at the customer’s charge.
b) Validity: only on the date the purchase order is sent. They include the TVA applicable on the day of the order.
c) The full price must be paid at the time the order is placed.
d) Delivery charges : Invoiced in addition and indicated before validating the order. If the product is lost, CYP Wheels undertakes to replace it only if the shipment insured has been chosen.
e) CYP Wheels reserves the right to modify prices at any time, without prior notice.
f ) Incorrect prices: If an erroneous and/or clearly derisory price has been published for reasons of human error, systems error, etc… the order will be cancelled even if it has been validated.
g) For shipments outside Switzerland, local VAT and any customs duties for goods are included and prepaid (only for retailers).

4) Payment

a) Payment may be made by choosing one of the methods indicated at the time of ordering.
b) The customer warrants that he/she has the necessary authorization to pay by the method of his/her choice.
c) CYP Wheels may suspend the order and delivery in the event that the credit institutions do not authorize payment by credit card. The same applies to payments that are not made.
d) Payment shall only be deemed to have been made when the amount of the price of the products and the related charges is actually on the account of CYP Wheels Sarl. The order shall be processed and the goods ordered shall only be dispatched upon actual crediting to CYP Wheels Sarl’s bank account.
e) CYP Wheels shall be the owner of the products until the moment of dispatch (date of delivery to the courier), which is subject to full payment of the order.
f) If payment is made by bank transfer in advance, it must be made within 12 working days from the date of acceptance of the order, after which time the order shall be deemed to be cancelled. The reason for the bank transfer must include the identification references of the order, issued in the online order confirmation.
g) CYP Wheels reserves the right to refuse a delivery or to accept an order from a customer who has not yet settled a previous order or with whom there is an ongoing payment dispute.

5) Terms and Methods of Delivery

a) CYP Wheels Sarl only dispatches directly to the customer,does not dispatch to mail boxes, post office boxes or other domiciliation service companies, no hotels.
b) Products shall be delivered to the address indicated by the consumer when placing the order.
c) For each order CYP Wheels issues a delivery document (receipt) or invoice for the material shipped. The information provided at the time of the order is used to issue the fiscal document. After the issuance of the document itself, no further changes can be made.
d) Upon delivery of the goods, the customer shall check that
– The quantity of the packages is correct and corresponds to the number indicated on the transport document
– The packaging is intact, undamaged, not opened, wet or altered.
– Any anomalies must be immediately reported to the carrier, with the words “withdrawal with reserve  per: ………..(insert reason) on the accompanying document, which must be signed by the customer
e) The customer must also report the anomaly found to CYP Wheels within 5 working days.

6) Problems and Delivery Errors or Non-Delivery

a) The goods, even if the packaging is intact, must be checked for damage.
b) Any damages or hidden anomalies shall be reported, within two days, in writing by means of registered mail, with return receipt, to the carrier whose address is indicated on the accompanying document. The customer shall send CYP Wheels a copy of this communication.
c) The courier shall make the first delivery without notice and in case of absence shall leave a notice and try again the next one within 24 hours. In the event of further absence, the goods shall be placed in storage and then re-arranged for delivery.
d) In the event of a delivery error and/or products that do not correspond to those listed in the order, the consumer must forward the claim, on the same day of delivery or at the latest on the first working day thereafter, to CYP Wheels.
e) In the event of a delivery error or exchange, any product to be exchanged or refunded must be returned to CYP Wheels Sarl in its entirety and in its original packaging by registered mail. In order to be accepted, returns must be communicated to CYP Wheels in advance.
f) If it is a mistake on the part of the consumer, the shipping costs shall be borne by the consumer, otherwise shall be borne by CYP Wheels.
g) In the event that the courier returns the product because it was not collected by the customer (ignored delivery notice, absence at the time of delivery,……etc.), the order shall be considered cancelled. The customer will receive the refund of the amount of the product, excluding shipping costs and any charges customs duties which will remain at his or her expense.

7) Right of Withdrawal

a) The consumer has the right (Consumer Code) to withdraw from the purchase contract within and no later than 14 days from the delivery of the product. If the deadline expires on a Saturday or Sunday, the deadline is the first working day thereafter. The right of withdrawal may only be exercised on the entire product. It will not be possible to exercise it on only a part of the purchase (e.g. accessories, ……other parts, etc.)
 b) All returns must be communicated to CYP Wheels in advance within the deadline in writing (by registered mail or by completing an online Form).
 c) If the package is rejected or returned to the carrier, upon delivery, the customer loses the right to withdraw.
 d) The Consumer must return the product in its entirety, in perfect condition, in its original packaging and in perfect saleable condition to CYP Wheels, by registered mail and traceable. Shipping costs for the return shall be borne by the consumer.
 e) The return shipment must be made no later than 14 days from the date of notice of withdrawal and is the responsibility of the customer until CYP Wheels confirms receipt of the product.

 f) The right of withdrawal shall be forfeited if the customer does not return the goods within 14 days of notice of withdrawal or in the event of obvious defect of the product itself (damage, wear and tear, dirt or lack of: inner packaging, original packaging and accessories).
g) The Right of Withdrawal does not apply to custom-made or personalized products (such as “a la carte” wheels), or custom-made components (e.g. spokes cut to size).
h) Refund: In case of exercising the Right of Withdrawal, CYP Wheels shall refund the customer within 14 days of receipt of the product.

8) Product Warranty

All products marketed by CYP Wheels Sarl are covered by the legal warranty of 24 months for conformity defects (see Chapter Warranty). CYP Wheels informs the consumer, in accordance with the law nr. 98-389, 19 May 1998, that it is not the manufacturer of the products/components presented and marketed on its website. Consequently, for any damage caused to a person or property by a defect of the product/component, the consumer may only assert the liability of its manufacturer, using the information on the product packaging. Conditions and warranty period can be found on the product sheets.

9) Causes of force majeure

If performance of the obligations of the contract is slowed down, hindered or obstructed by an accidental event or by force majeure, neither the seller nor the consumer shall be deemed to be in default.

a) “Force majeure” or “accidental event” shall be considered all unforeseeable external events, unavoidable, which do not depend on the will of the parties who, despite their efforts, can do nothing to prevent them.
b) Force majeure or fortuitous events are considered to be those envisaged by case law and others such as: the blockage of transport (deliveries or supplies), extreme weather conditions (storms, floods, lightning), interruption or difficulty of communication networks, road conditions.
c) The party affected by such events shall, within ten days of becoming aware of them, inform the other party.
d) If the duration of the case is long, the parties shall agree within one month on the conditions under which the contract may be continued.

10) Jurisdiction and Applicable Law

The sales contract between the consumer/customer and CYP Wheels Sarl is concluded in Switzerland and shall therefore be governed by Swiss law. All matters relating to the present general terms and conditions of sale and all aspects of orders and contracts shall be governed by Swiss law. Any disputes civil and criminal arising from the conclusion of this distance sales contract will be the exclusive jurisdiction of the court of District Court of Eastern Vaud, Rue du Simplon 22, 1800 Vevey, Switzerland.

11) Copyright

The structure, texts, images and all elements comprising the CYP Wheels Sarl website are protected by copyright. Their use and reproduction, in part or in full, is therefore prohibited without the authorization of CYP Wheels Sarl.

12) Modification of Conditions of Sale

The conditions of sale presented in this document may be modified by CYP Wheels, at at any time, without prior notice. They shall be valid from the date of their publication on the website of CYP Wheels Sarl.
